Municipal Law Enforcement Officer – CUPE 5167
Summary of Duties
Reports to the Supervisor of Operations and Enforcement. Investigates and enforces City of Hamilton by-laws such as Property Standards, Yard Maintenance, Zoning, Noise, Heat, Vital Services, Renovation License and Relocation By-Law, Safe Apartment Building By-Law and all other City of Hamilton related by-laws. Reviews, investigates and resolves related inquiries and complaints. From time to time investigates and enforces Council directed projects including Public Works Infill Closure Enforcement and Parks (Waterfall Enforcement).
General Duties
- Investigates and enforces City of Hamilton By-laws including Yard Maintenance, Zoning, Noise, Heat, Vital Services, Property Standards infractions under the Ontario Building Code, Parks (waterfall enforcement), Public Works (road closure, permit requirements) By-Laws, Renovation License and Relocation By-Law, Safe Apartment Building By-Law and other By-Laws.
- Investigates and analyzes assigned inquiries/complaints to determine potential or actual violations.
- Performs proactive and reactive site visits, patrolling on foot at times on uneven terrain, standing and walking for lengths of time, engaging with individuals to educate and enforce compliance.
- Utilizes policy and procedures to interpret and apply the correct by-law to ensure enforcement and compliance.
- Takes appropriate enforcement action including issuing orders, Administrative Penalty Notices, POA tickets and summonses.
- Identifies and makes recommendations for management approval when enforcement decisions require consideration of evidence and compliance history.
- Completes written and verbal reports and correspondence.
- Contacts and liaises with other regulatory agencies such as Ministry of the Environment, Conservation and Parks, Hamilton Police Services and other municipal departments.
- Utilizes vehicle equipped laptop as a mobile workstation; limited time spent in office.
- Maintains paper and computerized records for investigations, interviews, and inspections.
- Prepares, collects and gives evidence in court and License and Property Standards Committee meetings; acts as witness for Landlord Tenant Board hearings as summoned.
- Provides feedback on by-law amendments and policy/procedural changes.
- Operates equipment such as two-way radio, cell phone, thermograph, noise meter, computer, digital camera and construction measuring tools to support inspections and evidence collection.
- Drives a vehicle to conduct investigations/inspections and attend other agencies, offices and court.
- Works in various outdoor conditions including inclement weather, dust and dirt.
- Required to wear a uniform.
- Works in compliance with Health and Safety legislation and all City policies and procedures relating to Occupational Health and Safety.
- Performs other related duties as assigned.
Qualifications
- Previous law enforcement experience or relevant education such as Protection, Security and Investigation administration or Police Foundations.
- Knowledge of the Ontario Building Code is an asset.
- Completion of the Ontario Property Standards Association Basic Course (Level I) or ability to complete within one year in the position is required. Preference given to candidates who have completed Level I. Ability to complete Intermediate (Level II) within two years and Advanced (Level III) within three years.
- Successful completion of Municipal Law Enforcement Officer’s Association Foundations and Advanced courses is an asset.
